As the bill was just signed today, it is unclear on how an insurance company will comply. The original post states "The section on mental health parity is located on pages 310-344 of the displayed law." Please click on the link in the original post to review the law.

We are not experts on law, including the interpretation of law. We recommend that you read the law and decide for yourself.

People will have to contact their insurance company to see when and how they will comply. We suspect it will take a while for each state and insurance companies to review the law and determine how they will comply with it.

I did find this information in the bill.

Subtitle B—Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008

Page 340 of the bill states the following:

"(e) EFFECTIVE DATE.—

"(1) IN GENERAL.—The amendments made by this section shall apply with respect to group health plans for plan years beginning after the date that is 1 year after the date of enactment of this Act, regardless of whether regulations have been issued to carry out such amendments by such effective date, except that the amendments made by subsections (a)(5), (b)(5), and (c)(5), relating to striking of certain sunset provisions, shall take effect on January 1, 2009. "

The section continued in discussion on effective dates for collective bargaining..

Again, we are not experts on law, including the interpretation of law. We recommend that you read the law, get expert legal opinion and decide for yourself.

The good news is that for people, families, children and adults with mental health issues will have parity with those physical health issues in regards to health care.

When will the new mental health parity act go into effect? Should one contact one's insurance company for further information?
